PSC invites stakeholders to validate draft rules on removal of DPP

The Public Service Commission has reviewed draft regulations on removing the Director of Public Prosecutions and set a March 23, 2026 virtual forum to validate the rules after nationwide consultations.

The Public Service Commission has reviewed the Public Service Commission (Removal of the Director of Public Prosecutions) Regulations, 2026, which are anchored under Article 158 of the Constitution and designed to provide a formal framework for handling petitions seeking the removal of the DPP.

The Commission has now called a validation forum on March 23, 2026 following nationwide stakeholder consultations and written memoranda submissions.

In a public notice issued on Tuesday, the Commission stated that it had “Reviewed the Public Service Commission (Removal of the Director of Public Prosecutions) Regulations, 2026.” The reviewed draft regulations are intended to provide “mechanisms for filing petitions for the removal of the Director of Public Prosecutions.”

The regulations are anchored under Article 158 of the Constitution, which outlines the process for removing the DPP.


According to the Commission, the draft rules will “provide a framework for consideration of petitions for the removal of the Director of Public Prosecutions.”


The Commission noted that the review process followed provisions of the Public Service Commission Act, 2017, specifically Sections 76 and 92, which guide its regulatory mandate.


As part of the development process, the Commission said views were sought from stakeholders.


It issued notifications dated March 26, 2024 and further notices through the My Gov pull-out on March 26, 2024 and April 9, 2024, requesting written memoranda.


“The Commission received the written memoranda which were considered for inclusion in the draft Regulations,” the notice stated.


Following the review, the Commission has now scheduled a one-day virtual validation forum on March 23, 2026, inviting institutions and individuals to participate.


The forum is intended to allow stakeholders to review and validate the draft regulations before final adoption.


Participants are required to submit details in advance, including the names of two representatives and their designations, the name of the institution (where applicable), email address, and cellphone number.


Submissions must be sent to the dedicated email address provided by the Commission, with an advance copy required on or before March 20, 2026.


The draft regulations are accessible on the Commission’s official website under the Publications-Legislation section.


The Commission emphasized that the development of the regulations aligns with its broader institutional vision of “A Values-Driven Citizen-Centric Public Service” and its mission “To ensure an efficient, effective, ethical and inclusive public service for delivery of quality services to the citizenry.”


The validation process marks a key step in formalizing procedures related to petitions for removal of the DPP, a constitutional office holder whose tenure and accountability mechanisms are set out in the Constitution.


By engaging stakeholders, the Commission says it aims to ensure that the regulations reflect legal requirements and public input.


The inclusion of stakeholder memoranda, it added, demonstrates commitment to participatory governance in line with constitutional principles.


Once finalized, the regulations will provide structured procedures for receiving, reviewing, and processing petitions for removal of the DPP under Article 158.


The Commission has indicated that the consultation process remains central to ensuring transparency and legal compliance.


The outcome of the validation forum on March 23, 2026 will inform the next steps in the regulatory process before the draft is finalized.
