A man from Kwale has been sentenced to 30 years in prison for defiling his 12-year-old stepdaughter, after prosecutors from the Office of the Director of Public Prosecutions (ODPP) proved their case in court.
In a statement issued by the ODPP on Wednesday, Resident Magistrate Ruth Ogolla found Mangisi Chaka Mangisi guilty of repeatedly defiling the minor between April 2021 and November 2022. The case was prosecuted by Assistant Director of Public Prosecutions Collins Orwa and Prosecution Counsel Mahdy Twalib.
Mangisi was convicted of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act, 2006, and of committing an indecent act with a child under Section 11(1) of the same law.
According to court records, the offences took place in Kayawaa Village, Waa Location, Matuga Sub-county. The prosecution told the court that the accused repeatedly assaulted the girl while she was under his care.
The abuse came to light on January 4, 2023, when the girl confided in her guardian, who immediately reported the matter to the police. The victim was taken to Kwale Sub-county Hospital for a medical examination, and a P3 form was filled as part of the evidence presented in court.
Investigations later led police officers to Lungalunga, Mwamose Village, where statements were recorded from witnesses linked to the case. Their testimonies supported the victim’s account, culminating in Mangisi’s arrest on January 22, 2023.
While delivering the judgment, Magistrate Ogolla said the prosecution had presented “watertight evidence warranting conviction and sentencing,” noting that the testimonies of five witnesses proved the case beyond reasonable doubt.
The ODPP welcomed the ruling, saying it reinforces Kenya’s commitment to protecting children from sexual violence.
“The conviction and sentence mark a significant step in ensuring justice for the minor and sending a message that sexual offences against children will be prosecuted to the fullest extent of the law,” the ODPP said.
