Court defers plea for State House murder suspect pending mental test

The High Court has postponed the plea-taking of Kithuka Musyimi, the main suspect in the killing of a General Service Unit (GSU) officer attached to State House, until a mental assessment report is completed.

When the case came up before Justice Diana Kavedza on Thursday, November 13, 2025, the prosecution informed the court that the report required to determine the suspect’s mental fitness to stand trial was still pending. The report, they said, would be ready within two weeks.

Justice Kavedza stressed that the assessment was a key step before the accused could enter a plea to the murder charge. “We do not have the mental assessment report. Without it, we will not know whether your client is fit to plead,” the judge said. “We will therefore give a further mention on November 27 for the plea.”

The prosecution, represented by a State counsel, told the court that the evaluation was being conducted at Kenyatta National Hospital and that efforts were underway to speed up the process. Musyimi will remain in custody until the report is filed and the court decides on the next course of action.

Musyimi is accused of killing GSU officer Ramadhan Khamisi, who was stationed at State House Gate D along Dennis Pritt Road in Nairobi. The attack, which occurred in October, has been described by investigators as an unusual and violent act within one of the country’s most secure zones.

According to court documents, the slain officer was on duty at the search barrier when he was allegedly attacked by a man armed with a bow and two traditional arrows concealed in a blue sack. "The respondent, who was armed with a bow and arrows that he had concealed in a blue sack, posing as a street dweller, advanced towards the GSU officer manning the search barrier, one Ramadhan Khamisi," the documents state.

“He threw two arrows; the second one got to the officer Ramadhan, after which they were able to apprehend the suspect,” testified investigating officer Inspector Bashir Boya.

Khamisi suffered severe injuries and was rushed to Kenyatta National Hospital, where he later died while receiving treatment. Inspector Boya told the court that police recovered the weapons believed to have been used in the attack and confirmed that the suspect was subdued and arrested shortly after the incident.

Musyimi remains in custody as the investigation continues and the court awaits the outcome of his mental assessment before the plea can be taken.
