A Mombasa court on Monday handed down a life sentence to a man found guilty of sexually assaulting and defiling three young girls, sending a clear message about the consequences of crimes against children.

The ruling follows a thorough prosecution that relied on credible victim testimonies, medical evidence, and witness accounts to prove the case beyond reasonable doubt.

Jonathan Mutuku, in his 40s, was convicted by Mombasa Resident Magistrate Green Odera on multiple counts related to sexual offences against minors. The offences occurred on September 26, 2023, in the Kibarani area of Mikindani, Jomvu Sub-County, Mombasa County, and involved girls aged eight and nine.

The Director of Public Prosecutions (DPP) described the victims’ accounts as consistent, credible, and free from malice, noting that the prosecution had presented sufficient evidence to secure a conviction.

“In his ruling, Odera found the victims’ accounts consistent, credible, and free from malice, noting that the accused’s defence was a mere denial,” the DPP said in a statement.

Mutuku was convicted on two counts of defilement under Section 8(1) as read with Sections 8(2), 8(3), and 8(4) of the Sexual Offences Act, No. 3 of 2006. He was also found guilty of committing an indecent act with a child under Section 11(1) and one count of sexual assault contrary to Section 5(1)(a)(i) as read with Section 5(2) of the Act.

The prosecution, led by Principal Prosecution Counsel Purity Musembi, called eight witnesses, including the three minors, a clinical officer, and the investigating officer. Medical documentation, specifically P3 and PRC forms, corroborated the children’s testimonies and confirmed injuries consistent with sexual assault, strengthening the state’s case.

The court dismissed Mutuku’s defence, which was limited to denial, and determined that the prosecution had met the legal threshold required in criminal cases. The life sentence reflects the severity of offences under Kenya’s Sexual Offences Act, which mandates life imprisonment for defilement of children under the age of 11.

“The court held that Prosecution had proved its case beyond reasonable doubt and proceeded to sentence Mutuku to life imprisonment,” the DPP said, emphasizing the broader effort to protect vulnerable members of society and uphold the law without fear or favour.

The accused has been given 14 days to appeal both the conviction and sentence, in accordance with legal procedure. Authorities highlighted the importance of coordinated prosecution, credible witness testimony, and proper medical evidence in achieving justice for victims of sexual violence.

This ruling underscores the commitment of Kenya’s justice system to safeguard children and hold perpetrators of sexual offences accountable, sending a strong warning to anyone who might harm minors.
