The decision means the National Executive Committee (NEC) resolution adopted on June 22, 2026, removing Sifuna from the party's top administrative position, remains operational for now.
The Mumias East MP also questioned why Sifuna was still challenging his removal from office despite the decision having been endorsed by ODM's National Executive Committee (NEC).
Although the court ultimately upheld the appointments, the judge maintained that the Constitution does not recognise the framework that brought opposition politicians into government without a formal coalition or merger agreement.
Despite their reservations, Sifuna said several of the legislators have assured him that they intend to formally join the movement when they believe the political environment is more favourable.
