Speaking on Thursday while presenting a review of the commission's dispute resolution process, IEBC said its powers to hear nomination-related disputes are drawn from Article 88(4)(e) of the Constitution and the Elections Act.
The draft regulations are intended to implement the Election Campaign Financing Act by setting the highest amount candidates and political parties can spend during election campaigns. The limits are based on the size of the population and the geographical coverage of each electoral area.
In a public notice issued on Wednesday, the commission said the proposed regulations are intended to operationalise the Election Campaign Financing Act and strengthen oversight of campaign financing by candidates and political parties.
Among the changes under consideration is a proposal to repeal Section 21 of the Election Offences Act to allow IEBC to prosecute election-related offences. The commission argued that dealing with such offences is a function that should rest with the electoral body instead of the Office of the Director of Public Prosecutions.
The electoral agency has also proposed a Sh17.7 billion spending ceiling for political parties as it pushes for rules that would regulate campaign financing across all elective positions.
