IEBC invites public memoranda on draft campaign financing regulations for 2027 election

The Independent Electoral and Boundaries Commission (IEBC) has invited Kenyans to submit memoranda on proposed election campaign financing regulations, including draft campaign contribution rules, spending limits and authorised expenditures, as part of preparations for the 2027 General Election.

In a public notice issued on Wednesday, the commission said the proposed regulations are intended to operationalise the Election Campaign Financing Act and strengthen oversight of campaign financing by candidates and political parties.

The IEBC said the Constitution, under Article 88(4)(i), mandates it to regulate the amount of money that may be spent by or on behalf of candidates and political parties during elections.

"The Constitution of Kenya (2010), under Article 88(4)(i), mandates the Independent Electoral and Boundaries Commission (IEBC) to regulate the amount of money that may be spent by or on behalf of a candidate or party in respect of any election," the commission said.

It noted that the Election Campaign Financing Act provides for the regulation, management, expenditure and accountability of campaign funds, with candidates and political parties expected to self-regulate under the commission's oversight.

According to the IEBC, Section 29 of the Act empowers the commission to develop regulations governing campaign expenditure, contributions, disclosures, monitoring and record-keeping, while Sections 12, 18 and 19 require it to prescribe campaign contributions, spending limits and authorised expenditures at least 12 months before a general election.

"Pursuant to Sections 12, 18 and 19 of the Act, the Commission, in readiness for the 2027 General Election, has developed the Draft Regulations, Contributions, Authorised Expenditures and Spending Limits," the notice stated.

The electoral agency has now called on members of the public to review the draft regulations and submit their views by July 15, 2026.

"The IEBC invites the public to submit memoranda on the Draft Regulations and the Contribution and Spending Limits on or before 15th July 2026," the commission said, adding that submissions can be sent electronically or delivered physically to its offices across the country.

The draft regulations and spending limits are available on the commission's website.

The public participation exercise comes as the commission moves to implement the Election Campaign Financing Act, which has remained largely dormant since it became law in 2013.

The invitation follows the IEBC's publication of proposed campaign spending caps ahead of the 2027 General Election, including a Sh4.44 billion ceiling for presidential candidates and a Sh17.7 billion limit for political parties.

The draft regulations also propose expenditure limits for governors, senators, MPs, MCAs and other elective positions, with the commission saying the measures are intended to promote transparency, accountability and fairness while curbing excessive campaign spending.
