680 victims receive Sh896m compensation as 472 claims remain pending

The Panel of Experts on Compensation of Victims of Human Rights Violations has disbursed Sh896.1 million to 680 victims, while 472 other claims remain pending due to inadequate supporting documents.

The Panel, which handles claims arising from human rights violations, including demonstrations and public protests, in a statement on Friday said the compensation had been processed under various categories of harm.

Makau Mutua, the chairperson of thePanel of Experts on Compensation of Victims of Demonstrations and Public Protests, said the total amount has been released in three phases, with Sh448.7 million paid in the initial phase, Sh225.4 million in the second phase and Sh247.95 million in the third phase.

The Panel said the outstanding claims were among those initially submitted to the Independent Policing Oversight Authority (IPOA) and the Kenya National Commission on Human Rights (KNCHR).

It attributed the delay to insufficient documentation required to support the claims.

The Panel said it is working with IPOA regional offices to trace affected victims and their beneficiaries and help them obtain the necessary documents.

The process is aimed at allowing the claims to proceed to determination and compensation where the applicants meet the requirements.

The Panel said it continues to receive a high number of claims directly at its offices at the Kenyatta International Convention Centre (KICC) and through other channels.

Each claim is subjected to scrutiny before a decision is made on whether it should be approved, referred for further investigation or declared ineligible under the 2026 Reparations Guidelines.

“Each claim is directed to its proper resolution of approval, referral for further investigation, or ineligibility,” Mutua said in the statement.

The compensation programme covers different forms of harm, including fatalities, injuries and economic losses.

The Panel's third-phase summary lists 175 beneficiaries, comprising 50 victims of fatality, 46 with severe injuries, 49 with moderate injuries, 21 with minor injuries and nine who suffered economic losses.

The table gives compensation amounts of Sh3 million for fatalities, Sh1 million for severe injuries, Sh500,000 for moderate injuries and Sh50,000 each for minor injuries and economic losses.

Separately, the Panel said nine claims had been lodged under the sexual offences category. Eight have already been processed and compensated, while one remains pending.

It also said claims involving enforced disappearances are undergoing intensive investigation and verification because of the complexity of such cases.

The Panel said its work is guided by a victim-centred process based on “integrity, transparency, and compassion.”

It further pledged to periodically publish the names of compensated beneficiaries in the Kenya Gazette while ensuring compliance with the Data Protection Act.
