A Mombasa court has sentenced two men to life imprisonment in separate defilement cases involving four minors in Changamwe and Jomvu sub-counties after finding that the prosecution had proved the offences beyond reasonable doubt.
In the first case, Resident Magistrate Hon. Green Odera sentenced 32-year-old Darius Mboga, also known as Kevo, after convicting him on three counts of defilement contrary to Sections 8(3) and 8(4) of the Sexual Offences Act. He was also found guilty on three counts of committing an indecent act contrary to Section 11(1) of the Act.
The court heard that between 2021 and May 11, 2022, Mboga, who operated a barber shop in the Msikiti-Noor area, sexually abused three boys aged nine, 12, and 16.
Principal Prosecution Counsel Purity Musembi presented six witnesses. In his judgment, Hon. Odera ruled that "the prosecution had proved its case beyond reasonable doubt," adding that "medical evidence corroborated the minors' testimony as well as that of other witnesses."
The court heard that the accused had presented himself as a Good Samaritan by taking in the boys after their mother died, but instead repeatedly abused them.
The crimes came to light after a teacher noticed one of the boys walking unusually and, upon questioning, the child disclosed the abuse. Medical examinations at Coast Provincial General Hospital later confirmed sexual assault.
In a separate case, the same court sentenced 24-year-old boda boda rider Hassan Bakari Kombo to life imprisonment after convicting him of defiling an eight-year-old Grade Three pupil.
The court heard that the offence occurred on December 7,2024 at about 2:00am in Mnazi Mmoja, Mikindani Location, after the child's guardian left her in the accused's care while going to work.
Hon. Odera said the prosecution, which called five witnesses, had also "proved its case beyond reasonable doubt." He noted that medical evidence supported the witnesses' accounts and dismissed the convict's defence that he had been framed.
Both convicts were granted 14 days to appeal against their convictions and sentences.
