The Director of Public Prosecutions (DPP) on Wednesday approved three counts of receiving a bribe against prosecutor Samuel Mugo Kiarie, following a review of an inquiry file submitted by the Ethics and Anti-Corruption Commission (EACC).

The DPP said the evidence was “sufficient and credible” to sustain criminal charges and emphasized that no officer is above the law.

In a statement dated March 4, 2026, the DPP said the office had conducted an independent evaluation of the materials before reaching the decision.

“Upon an independent evaluation of the evidence presented, the DPP has established that there is sufficient and credible evidence to sustain criminal charges against Kiarie,” the statement read.

The prosecuting authority approved the charges under Section 6(1) read together with Section 18 of the Bribery Act. It further directed that Kiarie be arraigned before a court of competent jurisdiction to answer to the three counts.

The allegations stem from conduct investigated and forwarded to the DPP by the anti-corruption agency. “The DPP reiterates that no individual, regardless of office, rank or position, is above the law and the Office of the Director of Public Prosecutions will not hesitate to take decisive action against any officer who undermines the integrity of the Criminal Justice System,” the statement added.

The ODPP also reaffirmed its constitutional duty to act in line with the rule of law, public interest, and the proper administration of justice. “The ODPP remains committed to executing its constitutional mandate in accordance with the rule of law, public interest and administration of justice,” the statement read.

Kiarie is now expected to appear in court to respond to the charges. The case is significant as it involves a serving prosecutor being accused of corruption, an issue that has the potential to influence public confidence in legal institutions.

The DPP’s decision follows the standard cooperation framework between investigative bodies and the prosecuting authority, in which cases referred by agencies like the EACC are carefully reviewed before formal charges are approved.
