The High Court in Kiambu has ordered the release of Mukurwe-ini MP John Kaguchia from police custody after granting his application for bail.
Justice Njoki Mwangi directed that Kaguchia be released forthwith upon depositing a police cash bail of Sh100,000.
The court also directed the respondents, including the Inspector General of Police and the Director of Public Prosecutions, to file and serve their responses to the application within 14 days.
The matter will be heard virtually on September 16, 2026.
The lawmaker had earlier been arrested over alleged incitement remarks, with DCP chief Rigathi Gachagua claiming the MP is still being held at Kamukunji Police Station despite the court order.
"The OCS of Kamukunji Police Station is being misled by his seniors into ignoring the court order, which has already been served upon him, and continuing to detain Hon. Kaguchia," Gachagua said.
"My advice to the OCS is to obey the court order, as he will be held personally liable for contempt of court. When that time comes, his seniors will be nowhere to be found when he is cited for contempt. "
