Despite the family’s request for arrest warrants against the IG and DCI, the High Court declined, noting that the ODPP should first review the file before any action is taken. The matter is scheduled to return to court next week for further directions.

The search for missing security analyst Mwenda Mbijiwe took another turn in court on Tuesday as his family demanded that authorities produce him “dead or alive” and called for the arrest of the Inspector General of Police and the Director of Criminal Investigations.

Represented by lawyer Evans Ondieki, the family accused the State of neglecting its duty and treating the case with “utter disregard,” calling the prolonged proceedings a “circus” that has lasted four years without resolution.

“The subject has been held incommunicado for four years. We were only informed this morning that the ODPP has finally received the file. I urge this court to issue warrants of arrest against the IG to compel compliance with its orders,” Ondieki told the court.

He insisted that previous court directives requiring the authorities to present Mbijiwe have been ignored, leaving the family without answers or closure regarding his disappearance.

Ondieki further accused the police of showing contempt for court orders, arguing that the lack of action demonstrated a serious lapse in accountability by the security agencies responsible for investigating the matter.

The Office of the Director of Public Prosecutions confirmed it had recently received the case file and emphasized its responsibility to investigate and ensure justice in sensitive matters such as Mbijiwe’s disappearance. A representative from the ODPP told the court that the case would be examined carefully to determine the next steps in the investigation.

Despite the family’s request for arrest warrants against the IG and DCI, the High Court declined, noting that the ODPP should first review the file before any action is taken. The matter is scheduled to return to court next week for further directions.

Mwenda Mbijiwe, a former Kenya Defence Forces officer and well-known security analyst, disappeared in June 2021 while travelling from Nairobi to Meru. His vehicle was later found abandoned near Nyeri, but no trace of him has been found since.

His relatives have repeatedly accused the security agencies of failing to thoroughly investigate the disappearance and allege possible State involvement or a cover-up. The family maintains that only strict court oversight can compel police compliance and uncover Mbijiwe’s fate.
