Content creator and media personality Azziad Nasenya has moved to the Commercial Court in Nairobi to challenge the planned auction of her Kileleshwa apartment worth Sh20 million.

She claims a savings and credit cooperative society (Sacco) is trying to sell her property unfairly, despite her having cleared all outstanding loan arrears tied to the mortgage facility.

In her court filing on Thursday, Azziad accuses the Sacco of acting in bad faith by instructing auctioneers to dispose of her home even after she settled her debt. She is seeking court orders to stop both the Sacco and its appointed agents from proceeding with the sale, which was to take place on October 8, 2025.

The loan agreement was finalized two days later, and by June 12, 2024, the apartment had been charged to the Sacco as security before being transferred to her ownership.

She says she started repaying the facility as required and had already paid Sh897,924.68 before running into financial difficulties that led to arrears of Sh1.5 million.

Azziad explains that the economic challenges facing many Kenyans at the time affected her ability to maintain regular payments but insists she made efforts to clear her dues.

Her affidavit indicates that on September 19, 2025, the Sacco deducted Sh2.45 million from her savings account to cover the arrears.

However, five days later, on September 24, she was informed that auctioneers had already been instructed to advertise her apartment for sale, with the Sacco claiming she still owed Sh21.88 million.

Through her lawyers, Azziad argues that the decision to sell her property was unjustified and contrary to the terms of their charge agreement. She maintains that the Sacco violated the terms of the contract, which, she says, clearly prohibits recalling the full loan amount before the repayment period ends.

“The court will note that recital ‘B’ of the charge expressly provides that the chargee shall not demand repayment outside the time specified by the agreement,” her documents state.

Azziad is now asking the court to declare the intended auction illegal and to issue restraining orders against any further attempts to sell the apartment until the dispute is fully resolved. The case is scheduled for mention for further directions.
