Sifuna secures temporary relief as tribunal stops ODM action

The Political Parties Disputes Tribunal (PPDT) has issued orders preventing the Orange Democratic Movement from carrying out its plan to remove Nairobi Senator Edwin Sifuna as Secretary General, pending a formal hearing on his challenge.

The Tribunal also blocked the party from publishing the controversial NEC resolution in the Kenya Gazette until the matter is resolved.

In its ruling, the acting PPDT Chairperson emphasized that the February 11, 2026 decision by the ODM National Executive Committee cannot be implemented while Sifuna’s application is under review.

“That pending the hearing and determination of this instant application, inter partes, this Honourable Tribunal hereby issues orders staying the implementation of the resolution made by the National Executive Committee (NEC) of the Orange Democratic Movement Party (ODM) on February 11, 2026, to remove Edwin Sifuna as the Secretary General of the Party,” the Chairperson stated.

The Tribunal further directed that neither ODM nor the Registrar of Political Parties may publish the resolution in the Kenya Gazette.

“Pending the hearing and determination of this instant application, inter partes, this Honourable Tribunal hereby issues an order restraining the respondents (ODM and the Registrar of Political Parties) from publishing in the Kenya Gazette the resolution made on February 11, 2026, to remove Edwin Sifuna as the Secretary General of the Party,” it added.

A hearing has been set for March 12, 2026, where both parties will present their oral submissions. Ahead of the hearing, ODM is required to file and serve its authority to swear affidavits along with transcripts within three days. Sifuna, on the other hand, has been granted seven days to file and serve his submissions.

“The respondent will have seven days from the date of service to file and serve their submissions; then the hearing, by way of highlighting oral submissions, will be held on March 12, 2026, at 10 am,” the Chairperson directed.

These interim orders ensure that the February 11 NEC resolution cannot take effect until the Tribunal fully hears the case and issues a final determination, giving Sifuna temporary protection against removal.
